Processing of data: terms and conditions

PURPOSE: Information on the processing of personal data pursuant to arts. 13 and 14 of Regulation (EU) 2016/679

Pursuant to arts. 13 and 14 of Reg. (EU) 2016/679, as amended, we inform you that your personal data will be processed lawfully and properly, in accordance with current legislative requirements. The following details are provided in this regard: SOURCE OF THE PERSONAL DATA (art.14, para. 2.f – Reg. (EU) 2016/679): the company collects the personal data directly from the data subject.

The Controller is Vehicle Service Group S.r.l. with registered office at Via Filippo Brunelleschi 9, 44020 Ostellato (FE).

The data requested may fall into the categories of ordinary and special personal data, which will be processed for the following purposes:

  • Execution of the outstanding contract and compliance with the related legal obligations (purchases etc.);

  • Transmission of advertising materials and commercial offers (at your request).

The personal data that you have given us may be accessed by the IT department and the webmaster, solely for the purposes of registration and/or managing your request, as well as by staff in the relevant business areas in order to satisfy your request.

Transmission abroad: your personal data might be transmitted to another country, specifically the United States of America, where the owner of this company, DOVER CORPORATION, is domiciled. Your data would be transmitted for organisational and administrative purposes in a suitable manner that ensures its privacy and protection, in compliance with the data security measures envisaged in Regulation (EU) 2016/679, as amended.

Your rights: You may ask the Controller at any time for information about the location of your data and how it is processed, in Italy and abroad, as well as obtain a copy of your data. The above requests must be made in a suitable manner that ensures their receipt (certified e-mail, registered letter etc.). You may ask the Controller for access to your data, its rectification or its erasure, as well as for the restriction of its processing. You may also object to the processing of your data or request its portability. You may revoke consent for the processing of your data for specific purposes and may also file complaints with the competent data protection authority.

Data retention period: your data will be retained for the entire duration of the relationship that resulted in its collection and, subsequently, for the period envisaged in the applicable regulations.

Lawfulness of processing: Your data is needed in order to complete the contract with the Controller and failure to provide it or give consent for its processing would make it impossible to execute the contract. Processing is therefore based on the outstanding contract or on legal requirements. Any additional processing will be subject to obtaining your consent in a suitable manner.

Methods of processing: Your data will be processed in both printed and electronic form, but will not be used for profiling purposes.

Our social media appearances:  data processing through social networks. We maintain publicly available profiles in social networks. The individual social networks we use can be found below.

Social networks such as Facebook, Google+ etc. can generally analyse your user behaviour comprehensively if you visit their website or a website with integrated social media content (e.g. like buttons or banner ads). When you visit our social media pages, numerous data protection-relevant processing operations are triggered.

In detail: If you are logged in to your social media account and visit our social media page, the operator of the social media portal can assign this visit to your user account. Under certain circumstances, your personal data may also be recorded if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies stored on your device or by recording your IP address.

Using the data collected in this way, the operators of the social media portals can create user profiles in which their preferences and interests are stored. This way you can see interest-based advertising inside and outside of your social media presence. If you have an account with the social network, interest-based advertising can be displayed on any device you are logged in to or have logged in to.

Please also note that we cannot retrace all processing operations on the social media portals. Depending on the provider, additional processing operations may therefore be carried out by the operators of the social media portals. Receiving the newsletter

With the aim of offering a more complete service to its customers, our company can send emails containing updates, news and notices relating to the products and services available. The sending is linked to the relationship of customers and/or potential customers and is sent to the address given. Additional data is not required.

The above-indicated data is used only for sending the requested information and is not forwarded to third parties. In any case, receiving the email notifications can be stopped at your request, as indicated in the emails themselves. This interruption will have no effect on any further services to the customer.

Mailup

To send the newsletter we use the Mailup service, which enables us to organise and analyse email dispatch. The provider is Growens S.p.A, Via Pola 9, 20124 Milan, Italy.

The email addresses are stored on the Mailup servers in Italy. If you do not wish the data to be analysed by Mailup, you must unsubscribe from the newsletter. For this purpose, we provide the corresponding link in every newsletter message.

How the Mailup system works

The emails sent using Mailup enable us to determine whether the message has been correctly delivered and opened by the addressee. Should the email contain links to specific pages, the system affords us information on which links have been selected so that we can offer products, services and information that are progressively more suited to the interest of our customers.

Legal background

The data processing is based on your consent in compliance with art.130 clause 4 of Law D.Lgs.196/2003. You may revoke this consent at any time. The legality of the data processing operations already carried out remains unaffected by the revocation.

Storage duration

The data you enter for the sending of the newsletter will be stored by us until the user requests cancellation. Cancellation of the newsletter leads to entering the contact data in the list of customers who do not wish to receive the newsletter. The information stored by us for other purposes (e.g. email addresses for the users’ area) remain unaffected. The customer can always exercise the right to cancellation, modification, rectification of the data in accordance with EU reg. 2016/679.

Further guarantees

We have stipulated with Mailup a contract in accordance with article 28 of the GDPR, in which we obligate Mailup to protect our customers’ data and not transfer it to third parties. This guarantees that our services supplier respects the robust requisites of the law on data protection to all effects during the sending of the newsletter. Legal basis

Our social media appearances should ensure the widest possible presence on the Internet. This is a legitimate interest within the meaning of Art. 6 (1) lit. f GDPR. The analysis processes initiated by the social networks may be based on divergent legal bases to be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 (1) (a) GDPR).

 

Responsibility and assertion of rights

If you visit one of our social media sites (e.g., Facebook), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during this visit. You can in principle protect your rights (information, correction, deletion, limitation of processing, data portability and complaint) vis-à-vis us as well as vis-à-vis the operator of the respective social media portal (e.g. Facebook).

Please note that despite the shared responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are determined by the company policy of the respective provider.

Storage time

The data collected directly from us via the social media presence will be deleted from our systems as soon as the purpose for their storage lapses, you ask us to delete it, you revoke your consent to the storage or the purpose for the data storage lapses. Stored cookies remain on your device until you delete them. Mandatory statutory provisions – in particular, retention periods – remain unaffected.

We have no control over the storage duration of your data that are stored by the social network operators for their own purposes. For details, please contact the social network operators.

 

Should you wish to refuse consent for the processing of your data for certain purposes or in certain ways (if not essential for the satisfaction of your requests), please notify promptly the Controller, the Processor or the Data Protection Officer.
